WHY? Because You should get to decide what type of society you live in and not the Courts.

The 14th Amendment took away our control of gun rights and gun laws. And then, slowly, over time, the Federal Courts, without accountability, usurped that control. Now, because of the Federal Court’s involvement, it seems that we are perpetually ‘just’ one Justice’s vote away from getting or losing what we want.

That’s not right but that is an unintended consequence of the 14th Amendment.

We want to give control of gun rights and gun laws back to the People of the United States.

Our Right

The Second Amendment is an Absolute Prohibition
Against the Federal Government

As it should be. The Second Amendment does not need to be changed in anyway, and, if anything, the interpretation of the Second Amendment should be strengthened to remove the vagaries of the Federal Courts from its effectiveness.

So, what did the Second Amendment do? It prohibited the Federal Government from regulating the arms of all citizens of the United States collectively and left it to the State and local governments to regulate their State militia and the arms of their citizens. It certainly didn’t say that nobody should be responsible for regulating arms. That would be irresponsible.

However, that is what the 14th Amendment did.

The 14th Amendment, as interpreted by the US Supreme Court, basically says if the Federal Government cannot regulate arms then neither can the State or local governments. We think that is irresponsible, an unintended consequence of the 14th Amendment. And worse . . .

Good Laws are made for Our Benefit

Bad Laws are made to be Changed.

Our Laws Should Work For Us

Our laws should fit our needs and desires now. Originally, good laws were created for the benefit of society. However, sometimes, things change, and sometimes, what once was perceived as a good law is now perceived as a step behind and should to be changed.

Amending the 14th Amendment is not a movement for or against gun rights, or for or against gun laws. It is a movement to remove gun regulation from the Federal Courts and place it squarely in the hands of the people.

What is Allowed in One Setting is Not Necessarily Proper in Another

People have varied interests. We live and operate in different locations and scenarios. Our laws should accommodate for these differences.

The Framers of our Constitution handled this diversity by creating some laws that apply to everyone (Federal Laws), and some laws that are determined at the State or local level to handle local or situational issues.

What’s the Backstory?

The 14th Amendment was written by Reconstructionists in 1868 and was an attempt to fix all the ills of the Civil War within one Amendment. In trying to do so, the 14th Amendment ended up having many unintended consequences.

What is equally disconcerting is the Federal Courts have expanded the reach of the 14th Amendment slowly, inch-by-inch, on a case-by-case basis. This expanded interpretation should be reined in legislatively and not left to the vagaries of a particular Federal Court and the inevitable change in that Court’s ideological make-up.

We need to change the 14th Amendment to re-establish each States’ Rights and Protections because, over time, the Courts have changed their interpretation of the 14th Amendment.

We believe, in regard to the Second Amendment, one size fits all does not work.

Since our Constitution was ratified, it has been amended 27 times. We believe the time has come to amend our Constitution again. It’s time to amend the 14th Amendment.

It’s Time to Amend the 14th Amendment!

In the vernacular of the Framers:

We want to amend the 14th Amendment so that the restrictions of the Second Amendment are not incorporated by the Courts against the States.

Amending the 14th Amendment will remove gun legislation from the purview of the Courts.

This will return the responsibility and the obligation of protecting our gun rights and controlling our gun laws back to the States and squarely in the hands of we the people.

After we Amend the 14th Amendment, we anticipate some places - Montana, for example - may want fewer restrictions, and some places - maybe Chicago - will want more regulations. Importantly, both will have the ability to get what they want and live in the type of community they want because we worked together today to “Amend the 14th Amendment.”
