What We Propose to Do

We propose to amend the 14th Amendment to state that the restrictions of the Second Amendment are not incorporated against the States.

We need to get the control of our gun laws out of the hands of the Federal Courts and into the hands of the citizens. To do this, we need to amend the 14th Amendment.

If we amend the 14th Amendment, the States will regulate its citizens’ right to bear arms, and this right will not be subject to the Federal Government or the vagaries of the Federal Courts as it is now.

If we do not amend the 14th Amendment and give control back to the States, no meaningful change or assurances in our gun laws can take place. We will be at the mercy of the Federal Courts; their whims, their vagaries and their ideological make up at any given time.

Right now, the pendulum of the Courts is leaning towards a more conservative interpretation of the Second Amendment. Gun owners may feel secure in their Second Amendment rights, but this pendulum can change and that security can be fleeting.

As an example, in McDonald v. Chicago, the vote was 5-4, and Justice Breyer wrote in the dissent: "In sum, the Framers did not write the Second Amendment in order to protect a private right of armed self-defense. There has been, and is, no consensus that the right is, or was, 'fundamental.’”

So, Breyer’s opinion is out there that nothing in our constitution makes a private right to bear arms for self-defense fundamental. Breyer’s opinion lost by 5-4. If the Supreme Court gets one more judge to think like Breyer, self-defense could no longer be a reason to bear arms.

If we were to amend the 14th Amendment and give the States control over gun rights for their citizens, then the State could legislate (make a law) stating that self-defense is a reason to bear arms, and the Federal Courts couldn’t overturn it.

Why not just leave it in the hands of the Federal Government? Because, that is the reason for the Second Amendment: to prohibit the possibility of a ‘tyrannical’ Federal Government from infringing on any of its citizens, which are all citizens of the United States no matter who they are or where they live, the right to bear arms; thus assuring a free State. And in the United States, that’s 50 free States.

We need to have the flexibility, State Rights, in our gun laws so differences can be accommodated for in places like Montana where guns are a way of life versus Chicago where guns are a way of death.

If Chicago wants to ban “bump stocks,” which convert a gun to an automatic weapon, or to ban assault rifles because they have no use in Chicago, let them. And if Montana wants to allow them because they are fun to use in the wide-open spaces of Montana, let them. But to do either, we need to amend the 14th Amendment first in order to let each community, State or local, get what they want.

One-size fits all doesn’t work for gun rights or gun regulations.

It is worth repeating here that amending the 14th Amendment is not a movement for or against gun rights, or for or against gun laws. It is a movement to remove gun regulation from the Federal Courts and place it squarely in the hands of the people.

To amend the 14th Amendment and give the responsibility of ensuring gun rights and regulating gun laws to the individual States, we have created the Amend The 14th Amendment Political Action Committee which allows us to collect and expend funds to carry out our proposition above. More specifically, we have created what is called a Super PAC.

Donate. We need money to get this accomplished. We need you to donate, big or small, so we the people can control and assure our rights and protections, and not allow them to be subject to the whims of the Federal Courts.
